Version 1.0 · Effective 16 September 2026
1. Parties and acceptance
These Terms govern business use of DevInTouch Customer Care (the Service). The provider is Общество с ограниченной ответственностью «ВоркХаб» (“WorkHub LLC” is an explanatory translation only and is not asserted to be its registered English name).
- Registration number and taxpayer number (УНП):

The provider’s location does not by itself select governing law or a dispute forum. Customer or Tenant means the business identified in an Order Form or other accepted service agreement.
These Terms apply only when accepted by an authorised representative through an agreed acceptance method or incorporated into a signed agreement. Publication of these Terms alone does not form a contract.
2. Contract documents
The applicable agreement may include a signed or accepted Order Form, a data-processing agreement (DPA), these Terms, and the service description or policies expressly incorporated by the Order Form. A negotiated or signed term prevails to the extent it expressly overrides these Terms. No later website update silently changes an existing signed agreement.
3. Service scope
Depending on the Order Form and configuration, the Service may provide business accounts, customer-conversation intake, a CRM, contact and conversation records, assignments, human handover, reporting, audit evidence and optional integrations.
Facebook Messenger and Instagram integration is planned and is not represented as enabled merely because a Meta app or these Terms exist. When separately enabled, the Service may let the Customer connect an authorised Facebook Page or Instagram professional account and manage messages through the configured inbox. An AI function is optional, requires separate configuration and must not be assumed to apply to Meta conversations.
Features, limits, implementation stage and availability are only those stated in the applicable Order Form and current configuration.
4. Customer responsibilities
The Customer is responsible for:
- having authority to connect each business Page, professional account and other channel asset;
- the legality of its business, content, purposes and instructions;
- end-user notices, lawful bases, consent or choices required in its markets;
- authorised-user access, operator actions and account security;
- the accuracy of its CRM, catalogue, offer and business information;
- handling controller-side privacy requests, with DevInTouch assistance under the DPA; and
- complying with channel rules, including the applicable Meta terms, messaging windows, permissions and prohibited-use rules.
The Customer must not submit malware, infringe rights, attempt to access another Tenant, bypass security or usage controls, use the Service unlawfully, or intentionally submit passwords, payment-card numbers, government IDs, health data or other sensitive data unless an expressly approved feature and lawful secure configuration permits it.
5. DevInTouch responsibilities
DevInTouch will perform only the obligations expressly accepted in the applicable agreement and DPA. The Service is designed to enforce Tenant separation, controlled access and auditable channel operations, but no system can guarantee uninterrupted or error-free operation.
No uptime percentage, response time, service credit, universal channel compatibility or business result is promised unless an Order Form or signed service-level agreement expressly provides it.
6. Data protection and deletion
For Customer end-user conversations and CRM data, the Customer normally acts as controller and DevInTouch as processor under the DPA. DevInTouch acts as controller for its own account, contract, billing, support, security and legal records where applicable.
The Privacy Notice and Data Deletion Instructions explain the public process. Exact retention, export and deletion commitments are stated in the Order Form, DPA or an approved retention policy; these Terms create no unverified deadline.
7. Meta and other third-party services
Meta Platforms, Chatwoot components, hosting providers and any optional AI or integration provider are subject to their own technical limits and applicable terms. Meta decides whether an app, permission or business asset is approved or available. DevInTouch does not guarantee App Review approval, permanent API access or uninterrupted third-party availability.
The Customer must not provide a Facebook or Instagram password to DevInTouch. Channel access credentials must be created, stored, rotated and revoked only through the approved connection process.
8. Optional AI
If the Customer separately enables an AI feature, the applicable Order Form, notice and configuration must identify its permitted purpose and controls. AI output may be incomplete or inaccurate and requires proportionate human review. It is not professional legal, medical or financial advice. No sales, conversion or revenue outcome is guaranteed.
9. Fees, term and support
Fees, currency, taxes, billing period, payment date, limits, subscription term, renewal, cancellation, support and any service levels are determined only by the applicable Order Form or signed agreement. If a term is omitted, these Terms do not invent it. These Terms establish no automatic renewal or default refund rule.
10. Suspension and termination
Any suspension or termination right, notice and cure process must follow the applicable agreement and mandatory law. Urgent measures may be necessary to address a verified security risk, unlawful use or provider restriction, but must be proportionate and documented.
On termination, access, export, channel disconnection, credential revocation and return or deletion of Customer Data follow the DPA and Order Form. These Terms do not promise an export format or deletion period that has not been approved and operationally verified.
11. Intellectual property and acceptable use
Each party keeps its pre-existing intellectual property. The Customer keeps its rights in Customer Data, content, trademarks and instructions. The Customer grants only the rights needed to provide, secure and support the Service under the agreement.
The Customer may not resell or sublicense the Service unless expressly agreed, reverse engineer it except where law cannot prohibit that activity, probe another Tenant, defeat safeguards or use the Service to make prohibited fully automated high-impact decisions about individuals.
12. Warranties, liability and disputes
Any warranties, remedies, indemnities, liability limits, governing law and dispute forum must be approved in the signed commercial terms and comply with mandatory law. These Terms deliberately establish none of those commercial or jurisdictional terms.
13. Contact and changes
Material changes will be communicated through the method required by the applicable agreement or law. The current version and effective date appear at the top of this page.
